01. Agreement to Terms
By placing an order through the KREATVITY online store (kreativity.com), you agree to the terms and conditions outlined below. These terms govern all online purchases made through the KREATIVITY webshop.
02. Orders and Updates
2.1 Shipping Origin
Orders placed outside Switzerland are dispatched from our designated European warehouse in Rheinfelden, Germany.
This approach helps reduce customs handling complexity and supports faster, more predictable international delivery.
2.2 Prices and Taxes
All listed prices are net and exclude local taxes. The following VAT rules apply depending on your location and tax status:
- EU Customers: VAT-free delivery is available for customers outside Germany who provide a valid EU VAT number. This number must be valid in the EU VIES system at the time of dispatch.
- Germany: Deliveries to business entities within Germany are subject to 19% German VAT, which will be applied if no valid VAT number is provided. Private individuals within the EU are welcome to purchase from us; however, a 19% VAT charge will apply. Due to EU VAT regulations, private customers cannot complete purchases directly through our online store. Please contact us first via our enquiry page to arrange your order.
- Switzerland: Deliveries to Switzerland are subject to 8.1% Swiss VAT.
- International (Non-EU): For all other destinations, the customer is responsible for all local import taxes, duties, and clearance costs.
2.3 Shipment Updates
Once goods leave our warehouse, KREATIVITY will provide shipment status updates via the webshop order area or by email.
If any issues arise during transit, KREATIVITY will assist in determining the status of the shipment in coordination with the logistics provider.
2.4 International Delivery
KREATIVITY uses UPS as its primary international logistics partner to ensure fast and reliable worldwide delivery.
Shipments are dispatched from Germany and, in many cases, can reach destinations such as California within three working days of pickup. UPS shipping costs are subsidised so customers benefit from premium delivery performance without paying standard UPS rates.
All shipments are supplied Delivered At Place (DAP). UPS manages transport and the import process. Customers remain responsible only for any applicable local taxes or duties.
2.5 Documentation and Customs
For higher-value orders or specific regional requirements, additional administrative fees apply to cover mandatory paperwork:
- Export Documents: A fee of €45 applies to all EU export orders exceeding €1,000 (including shipping).
- Certificate of Origin: If a Certificate of Origin is required, an additional fee of €65 / CHF 65 applies.
- Customs Process: All shipments are supplied Delivered At Place (DAP). UPS manages transport and the import process, while the customer remains responsible for local tax/duty payments.
03. Disclaimer
3.1 Product Misuse
KREATIVITY cannot be held responsible for issues arising from:
- Improper or unsafe use of the products
- Tampering, modification or unauthorised repair attempts
Such actions void the standard 6-month warranty.
3.2 Third-Party Statements
Kreativity is not liable for claims, guarantees or representations made by any dealer or any person not employed by Kreativity.
04. Commercial Distributor
4.1 Business-Only Purchasing
Kreativity supplies products exclusively to businesses and commercial users. By placing an order, you acknowledge:
- All products are offered for professional (B2B) use only and follow commercial trading standards.
- If a private individual places an order, they acknowledge the purchase is a commercial transaction and waive all statutory consumer rights associated with distance sales.
4.2 No Consumer Contracts
KREATIVITY is not configured to sell directly to private individuals. If a private individual places an order through the website, they acknowledge that:
- The purchase is treated as a commercial transaction
- Consumer online purchasing rights do not apply
- They waive all statutory consumer rights associated with distance sales
05. Product Dimensions
Any product dimensions or weights listed on the webshop are indicative only. Customers requiring exact specifications must contact us at info(a)kreativity.com to obtain confirmed measurements.
06. Dispute and Resolution
6.1 Dealer Disputes
If a dispute arises with a KREATIVITY dealer, customers must first attempt to resolve the matter directly with that dealer.
6.2 Payment Transaction Rules
KREATIVITY follows the standard dispute and resolution procedures defined by Stripe or other payment methods or by the relevant credit card provider.
6.3 Correspondence Language
All communication with KREATIVITY must be submitted in English or German.
6.4 Governing Law
The laws of Switzerland apply to any dispute or legal proceedings arising from online purchases.
07. Quality & Compliance
All products are manufactured using certified food-grade materials, supported by supplier documentation and material certificates. Independent laboratory testing is carried out periodically, including food migration testing to verify compliance with applicable regulations.
Products are designed and manufactured to comply with EU and US food-contact regulations. Each product includes a declaration of compliance within its instruction manual.
